• Engaging in activities that disrupt the Services, such as prompt manipulation, jailbreaking, or excessive usage.

AI Services

1. Definition: Our “AI Services” include human-supervised AI Assistants powered by an auto-tuning feedback loop, offering features such as custom HTML layouts for product, real estate, or other listings, and integration with external systems via the Model Context Protocol (MCP). These Services are designed to provide accurate, reliable responses tailored to your needs.

2. Auto-Tuning Feedback Loop: Our AI continuously monitors responses for accuracy and refines its knowledge base through automated data processing, which may involve analyzing user inputs and outputs to improve future responses, as detailed in our Privacy Policy.

3. Human Supervision: Expert human oversight complements the auto-tuning feedback loop. Our team reviews flagged responses to ensure accuracy, update data sources, or provide custom answers, particularly for complex queries or custom HTML layouts.

4. Custom HTML Layouts: Available in select subscription plans (e.g., “AI Power - Enhanced”), custom HTML layouts allow you to create visually appealing listings (e.g., product catalogs, real estate floor plans). You are responsible for providing accurate, lawful data for these layouts and ensuring compliance with applicable laws (e.g., copyright, advertising regulations).

5. User Responsibilities:

   • You must use AI Services lawfully and ensure that your inputs and data provided for custom HTML layouts do not infringe third-party rights or violate applicable laws.

   • You are solely responsible for reviewing AI-generated content, including custom HTML layouts, for accuracy and suitability before use.

   • You may not rely on AI Services for critical decisions (e.g., legal, financial, or medical advice) due to the potential for errors.

6. Prohibited Uses: In addition to the restrictions in “Use of the Services,” you may not:

   • Use AI Services to generate harmful, offensive, or misleading content.

   • Attempt to bypass AI safety mechanisms or manipulate outputs.

7. Third-Party Integrations: When using MCP to connect to external AI agents or data sources, you are responsible for complying with the terms of those third-party services. We are not liable for inaccuracies or issues arising from third-party data.

8. Content Ownership and Use:

   • You retain ownership of your inputs to the AI Services. Outputs generated by the AI Services (e.g., custom HTML layouts) are provided under a non-exclusive license for your use, subject to these Terms.

   • We may process and store your inputs and outputs for monitoring, improving the auto-tuning feedback loop, and ensuring compliance with these Terms, as outlined in our Privacy Policy.

   • You are solely responsible for any third-party claims (e.g., copyright infringement) arising from your use of AI-generated content.

9. Limitations: AI Services are provided for informational and business purposes and may generate incorrect or incomplete content. We do not guarantee the accuracy, completeness, or suitability of AI outputs, including custom HTML layouts, and you use them at your own risk.

Liability and Disclaimer
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, completeness, reliability, or suitability of the Services or any content, including AI-generated outputs or custom HTML layouts. You acknowledge that you rely on the Services and their outputs, including data retrieved via MCP, at your own risk. We are not liable for any damages arising from your use of the Services, including errors in AI-generated content or third-party integrations.

Indemnification
You agree to indemnify, defend, and hold harmless BizDriver.ai, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of or connected with your access to or use of the Services, including any AI-generated content or custom HTML layouts that infringe third-party rights or violate applicable laws.

Subscription and Pricing
We offer various subscription plans for the Services, as described on our website at the time of purchase. Certain features, such as custom HTML layouts, are available only in select plans (e.g., “AI Power - Enhanced”). You are responsible for providing accurate, lawful data for these features. You agree to pay all applicable fees for your chosen plan. We reserve the right to modify subscription plans or pricing at any time, with changes effective upon your next billing cycle. We will provide reasonable prior notice of such changes via email or a website notice. By continuing to use the Services after a price change, you accept the new price. If you do not agree, you may discontinue your subscription at the end of your current billing cycle.

Integration and Associated Work
You are responsible for any work associated with integrating and configuring the Services into your systems, including custom HTML layouts. This includes any modifications or adaptations required to use the Services. We may provide support for integrations via MCP, but we are not liable for any costs, time, or resources expended during integration or for any impacts resulting from changes to the Services, such as discontinuation or pricing adjustments. You acknowledge and accept all risks associated with integrating and using the Services.

Privacy
Our Privacy Policy, incorporated into these Terms by reference, explains how we collect, use, and share your information, including inputs and outputs processed for the auto-tuning feedback loop and human supervision. By using the Services, you consent to such data processing in accordance with our Privacy Policy and applicable laws (e.g., GDPR, CCPA).

Governing Law
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any disputes shall be resolved through binding arbitration in Delaware, administered by the American Arbitration Association, except for claims eligible for small claims court.
